LIMITED WARRANTY
STOKLEY'S SERVICES T/A COLD AIR PRODUCTS warrants the AVENGER portable cooling system will be free from defects in material and workmanship for a period of (12) twelve months from the date of purchase. The compressor only shall be warranted for a period of (36) months from the date of purchase. There are no warranties, express or implied, (including the implied warranties of merchantability and fitness) which extend beyond those specifically set forth above. STOKLEY'S SERVICES T/A COLD AIR PRODUCTS shall, at its sole option, repair or replace any defective product covered by this warranty.
This warranty does not cover defects which result from owner negligence or causes beyond STOKLEY'S control. This includes, but is not limited to:
- unusual physical or electrical stress
- accident, neglect, abuse, misuse or other abnormal use
- normal wear and tear
- repairs improperly performed or performed by an unauthorized person
- modifications or alterations to the AVENGER not authorized by STOKLEY'S SERVICES T/A COLD AIR PRODUCTS
- failure to perform routine maintenance in accordance with owner's manual
- all conditions specified in operations manual as voiding the warranty
This warranty is non-transferable and applies only to the original purchaser. Labor costs incurred for repair and replacement of parts during the warranty period shall be reimbursed to the purchaser by STOKLEY'S SERVICES. Prior approval by STOKLEY'S SERVICES must be obtained prior to any work being performed. Unauthorized repairs shall be the sole responsibility of the purchaser.
This warranty is in lieu of any obligations or liabilities on the part of STOKLEY'S SERVICES for damages arising out of or in connection with the sale, use or performance of the AVENGER including, without limitation, any lost profits or any other kind of consequential, incidental, special or exemplary damages of any kind.
